Draft

Draft — requires review by counsel before publication. Written by an AI assistant, not a lawyer. Every "For counsel" note marks a point that needs legal judgement.

These terms apply when you use TryYourSize as a shopper: the window on stores, your profile and the Body app at my.tryyoursize.com. The service is provided by [COMPANY LEGAL NAME], S.L., [REGISTERED ADDRESS], Spain ("TryYourSize"). How we handle your data is explained in the Privacy Policy.

1. The service

TryYourSize is free for shoppers. You measure yourself once with a tape; we compute a 3D body from your measurements and, on every store that has TryYourSize, suggest a size and describe how the garment fits you in physical terms (centimetres of room, pressure, stretch). Stores pay for the service.

2. Your profile

  • You need to be 16 or older to create a profile. A parent or guardian can add child profiles under their own profile.
  • Sign in with your email and a one-time code. Keep access to your email secure; anyone who can read it can sign in.
  • Enter your own measurements (or your child's, as their guardian), as accurately as you can. Results are only as good as the measurements.
  • One profile per person. Do not create profiles for other adults.

3. What a size suggestion is

A size suggestion is an estimate computed from your measurements and the data the store gives us about its garments. It is not a promise that a garment will fit or that you will like it. The store, not TryYourSize, sells you the product: your purchase, delivery, returns and your rights as a consumer are with the store.

4. Fair use

Do not misuse the service. In particular, do not:

  • access it by automated means (bots, scrapers, crawlers or scripts) or collect its results in bulk; use it yourself, through the window, the Body app and the stores' pages;
  • decompile or reverse-engineer it, or try to work out how its engine works, except where the law expressly allows it;
  • query it systematically or collect its outputs (sizes, fit values, 3D views) to copy, approximate or benchmark it for another product, or to train or evaluate machine-learning models;
  • try to read other people's data, interfere with its security, or enter data about others without their permission.

5. Ending

You can delete your profile at any time in the Body app (Your data → Delete my account). We may suspend a profile that breaks these terms, after telling you where possible. We may change or end the service; if we end it, we will tell you in advance and you can download your data first.

6. Liability

We provide the service with reasonable care. Nothing in these terms limits your rights as a consumer or our liability where the law does not allow it to be limited. Otherwise, because the service is free, we are not liable for the fit of a product you buy from a store.

7. Changes and law

We will tell you before significant changes to these terms take effect. Spanish law applies, without depriving you of the protection of the mandatory law of the country where you live. You can go to the courts of your place of residence.

For counsel: Check the consumer-law points: the free-service liability wording (TRLGDCU, Real Decreto Legislativo 1/2007, Art. 86), jurisdiction for consumers, whether an online dispute-resolution notice is still required, and how acceptance is recorded (today: by creating a profile; the window shows links, not a tick box).
